Usury calculator

APR %
The APR (TAE) appears in the contract and in the statements. It is the annual rate, not the monthly one.

How the check works

The 1908 Usury Act declares void any loan with an interest rate notably higher than the normal rate. Under Supreme Court case law, the benchmark is the average rate published by the Bank of Spain for the category closest to the transaction on the date of the contract. For revolving cards, interest exceeding that average by six points or more is usurious (judgment 258/2023 of 15 February), and for loans and finance, so is interest that doubles it (judgment of 23 June 2026).

The calculator compares your APR with the annual average of the relevant official series, with data up to August 2026. Once the loan is declared void, article 3 of the Act requires only the capital received to be repaid, and anything paid above it is deducted or refunded.

This tool gives an initial indication based on the annual averages of the Bank of Spain's official series. It does not replace a review of the contract and is not a legal opinion. The final result depends on the month the contract was signed, its specific terms and the court's approach. The data you enter is neither sent nor stored, as the calculation runs in your browser.
